Overview
These Terms of Use ("Terms") govern your access to and use of the HeriBase mobile application, website, and related services (collectively, the "Services") provided by HeriBase ("HeriBase," "we," "us," or "our").
By accessing or using the Services, you agree to these Terms. If you do not agree, please do not use the Services.
1. Eligibility
You must be at least 13 years old, or the minimum legal age required in your jurisdiction, to use the Services. If you use the Services on behalf of a company, organization, or other entity, you represent that you have authority to bind that entity to these Terms.
2. Description of Services
HeriBase provides tools that may help users identify, value, organize, and track collectible items. The Services may include image-based item recognition, collectible information and references, estimated value ranges, collection management, price tracking, optional review or support services, and subscription-based access to certain features.
We may update, modify, suspend, or discontinue any part of the Services at any time.
4. Accounts
You may need to create an account to use certain features. You agree to provide accurate information and keep your account information up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

5. User Content
You may upload or submit photos, descriptions, notes, collection records, and other content ("User Content") through the Services. You retain ownership of your User Content.
By submitting User Content, you grant HeriBase a worldwide, non-exclusive, royalty-free license to use, host, store, reproduce, process, analyze, display, and modify your User Content as necessary to provide, maintain, improve, and develop the Services.
You represent that you have the necessary rights to submit and use your User Content, that your User Content does not violate any law or third-party rights, and that it does not contain unlawful, harmful, misleading, or infringing material. We may remove or restrict access to User Content if we believe it violates these Terms or applicable law.
6. Acceptable Use
You agree not to use the Services for unlawful, harmful, fraudulent, or abusive purposes; upload infringing or malicious content; attempt to reverse engineer, copy, scrape, or interfere with the Services; bypass access controls, usage limits, subscription restrictions, or security measures; use automated systems without permission; misrepresent identity or item information; or use the Services to facilitate illegal transactions or prohibited activities.
7. Collectible Items and User Responsibility
You are responsible for the items you upload, describe, store, manage, or reference through the Services. HeriBase does not take possession of, verify, insure, certify, or guarantee any collectible item. Any decision to purchase, sell, insure, restore, preserve, authenticate, or otherwise act on an item is solely your responsibility.
8. Value Estimates and Market Information
Value estimates and market insights may be based on available data sources, historical references, market signals, item attributes, and other information. Because collectible markets can change and item condition can significantly affect value, estimates may be inaccurate, incomplete, outdated, or unavailable.
You should not rely solely on HeriBase for high-value transactions, insurance decisions, legal matters, tax reporting, or investment decisions.
9. Optional Expert Review
HeriBase may offer access to optional review or support services for selected items. Any review results are provided for informational purposes only unless expressly stated otherwise in writing. HeriBase does not guarantee that any review will identify every relevant detail, defect, authenticity issue, or valuation factor. Availability, pricing, scope, and turnaround time may vary.
10. Subscriptions, Trials, and Refunds
Certain features may require payment or a subscription. If you purchase through the Apple App Store, Google Play, or another app store, your purchase is handled by that app store and is subject to its payment terms, refund rules, renewal rules, and cancellation procedures.
Subscription fees may be charged on a recurring basis unless canceled before renewal according to the applicable app store's rules. We may change subscription features, pricing, or availability from time to time, subject to applicable law and platform rules.
We may offer free trials, discounts, or promotional access. Unless canceled before the end of the trial period, a free trial may convert into a paid subscription according to the terms displayed at purchase. Refunds for app store purchases are generally handled by the relevant app store according to its policies.
11. Intellectual Property
The Services, including software, design, logos, trademarks, text, graphics, user interface, and other content, are owned by HeriBase or its licensors and are protected by intellectual property laws. You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works based on the Services unless expressly permitted by law or by us in writing.
12. Third-Party Services and Links
The Services may contain links to third-party websites, tools, content, or services. We do not control and are not responsible for third-party services. Your use of third-party services may be subject to their own terms and privacy policies.
13. Privacy
Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, store, and protect information.

14. Service Availability
We work to provide reliable Services, but we do not guarantee that the Services will always be available, uninterrupted, secure, or error-free. We may suspend or limit access to the Services for maintenance, updates, security reasons, legal compliance, or other operational needs.
15. Disclaimers, Liability, and Disputes
To the maximum extent permitted by law, the Services are provided on an "as is" and "as available" basis. HeriBase disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and reliability.
To the maximum extent permitted by law, HeriBase and its affiliates, officers, employees, agents, partners, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages. HeriBase's total liability for any claim arising out of or relating to the Services will not exceed the amount you paid to HeriBase for the Services in the 12 months before the claim, or USD $100, whichever is greater.
You agree to defend, indemnify, and hold harmless HeriBase and its affiliates from claims arising from your use of the Services, your User Content, your violation of these Terms, your violation of law or third-party rights, or disputes involving items you own, upload, describe, value, buy, sell, or otherwise handle outside the Services.
You may stop using the Services at any time. We may suspend or terminate your access if we believe you have violated these Terms, created risk, or used the Services unlawfully or abusively. We may update the Services and these Terms from time to time. These Terms will be governed by the laws of [Insert Governing Jurisdiction], without regard to conflict of law principles.
If you have a dispute with HeriBase, please contact us first at contactus@heritcoin.com so we can try to resolve the issue informally. Any unresolved disputes will be handled according to the laws and courts of [Insert Jurisdiction], unless applicable law provides otherwise.
16. Apple App Store Additional Terms
If you download HeriBase from the Apple App Store, you acknowledge that these Terms are between you and HeriBase, not Apple; Apple is not responsible for the Services or their content; Apple has no obligation to provide maintenance or support services for the app; and Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them where applicable. Your use of the app must also comply with the Apple Media Services Terms and applicable App Store rules.
